How to create a rent agreement online
Start with the parties, property, agreed rent, deposit and tenancy period. Put the agreed terms into a draft, check the applicable state requirements, and arrange execution and registration where required. An online rental agreement is a way to prepare the document; saving a PDF alone does not complete those legal steps.
This guide includes a free starting format and a checklist for discussing the draft with your advocate. For an online lease agreement or rent deed, confirm whether the proposed arrangement is a lease, tenancy or leave-and-licence arrangement before choosing the wording.
Details to collect before drafting
- Full names and addresses of the landlord and tenant, and the authority of anyone signing for them.
- Property address, unit number, included areas, permitted use and an inventory of fittings.
- Monthly rent, due date, payment method, deposit and agreed refund process.
- Start date, term, renewal arrangements and any agreed rent increase.
- Responsibility for utilities, maintenance, repairs and property-related charges.
- Notice arrangements, handover conditions and treatment of damage or unpaid dues.
Use one consistent description of the property throughout the draft. Record existing damage in a dated handover inventory and keep photographs with the parties' agreed record. This reduces ambiguity when possession is returned.
Rent agreement format: a free starting template
Copy the following outline into an editable document and replace each bracketed field. It is a drafting outline that needs additional clauses and local review before signature.
Residential rent agreement outline
Date and place: [Execution date], [City and state].

Premises: [Complete address and description], with the inventory recorded in [Annexure reference]. The agreed use is [Residential use and any agreed restrictions].
Term: The proposed tenancy begins on [Date] and ends on [Date], subject to the agreed termination and renewal terms.
Rent and deposit: Monthly rent is [Amount], payable by [Due date and method]. The deposit is [Amount]. The parties will record the refund deadline, permitted deductions and supporting evidence in the final agreement.
Responsibilities: The final agreement will allocate utilities, maintenance, repairs and other charges, and set out access arrangements, notice procedures and possession handover.
Execution: [Landlord signature], [Tenant signature] and [Witness details, where applicable]. Complete the applicable stamping and registration requirements separately.
Clauses worth reviewing before you sign
Check that the deposit clause explains deductions and when the balance will be returned. Avoid leaving phrases such as “all damage” undefined; record the agreed treatment of ordinary wear, existing defects and damage attributable to occupation.
Set out how each party gives notice and which address or agreed communication channel they use. If the draft includes a lock-in period, early-exit payment or escalation clause, ask for its effect to be explained before agreeing to it. Do not reuse a commercial lease clause in a residential arrangement without checking its fit.
Read the inventory and the agreement together. A promise about parking, furnishings or repairs should appear in the written terms if the parties intend to rely on it.
Stamp duty, registration and the 11-month question
Under the central Registration Act, Section 17(1)(d) addresses compulsory registration of leases from year to year, exceeding one year, or reserving yearly rent, subject to the applicable legal framework. Check the current state amendments and the nature of your arrangement.
There is no universal rule that an 11-month agreement avoids every registration obligation. For premises covered by the Maharashtra Rent Control Act, Section 55 requires covered letting and leave-and-licence agreements entered into after commencement to be written and registered. Read the Act's scope and exceptions with local advice.
Stamping, notarisation and registration are separate steps. Check the applicable state registration department for the current process and charges. A notarised document does not replace compulsory registration where the law requires it.
Save your rental agreement and supporting records
Keep the editable draft, final signed version, payment acknowledgements, inventory and any registration record together. Before downloading or printing a rental agreement, compare the names, dates and amounts against the parties' instructions and remove every unfilled placeholder.
