Article 370 established a special constitutional arrangement for Jammu and Kashmir. It dealt with how provisions of the Constitution of India applied to the State and the role of Presidential orders. Searches for “art 370” or “act 370” usually refer to this constitutional article, rather than a separate Act of Parliament.

Understanding the provision requires separating its original text, the Presidential orders of 2019, and the Supreme Court's judgment of 11 December 2023. A short description such as “special status removed” does not explain each legal step.

What changed in 2019?

The Constitution (Application to Jammu and Kashmir) Order, 2019, known as C.O. 272, applied the Constitution of India to Jammu and Kashmir. C.O. 273 followed with a declaration under Article 370(3). The Jammu and Kashmir Reorganisation Act, 2019 addressed territorial reorganisation. These are distinct instruments with different legal functions.

For research, make a three-column timeline: instrument, date, and legal effect. Keep an official copy of each instrument beside the timeline. This prevents a parliamentary enactment from being confused with a Presidential order.

What did the Supreme Court decide?

In In Re: Article 370 of the Constitution, 2023 INSC 1058, the Supreme Court upheld the application of the entire Constitution and the declaration making Article 370 inoperative. The Court treated Article 370 as a temporary provision. It also found the use of Article 367 to change the meaning of “Constituent Assembly” invalid, while upholding the ultimate declaration on other reasoning.

That distinction matters when summarising the decision: the result does not mean every step of the government's reasoning was approved. Read the operative conclusions together with the reasons, and distinguish the different opinions in the judgment.

How to prepare an Article 370 research note

  1. State the constitutional question you are researching, rather than starting with a political conclusion.
  2. Identify the version of Article 370 relevant to the historical period.
  3. List C.O. 272, C.O. 273, and the Reorganisation Act separately.
  4. Record the Supreme Court's holding and the paragraph supporting each proposition.
  5. Separate the 2023 judgment from later developments. The judgment alone does not establish the current administrative position.

When using an AI summary, check whether it distinguishes the orders from the Act and identifies the Article 367 issue. Verify every quoted passage against the official judgment before including it in a brief.
