CCriminal Law

Section 207 of the Motor Vehicles Act, 1988 gives a police officer, or another person authorised by the State Government, the power to seize and detain a vehicle in specified situations. People searching for "207 MV Act" usually have a vehicle that has just been taken away and want to know why and how to get it back.

When can a vehicle be seized under Section 207?

The power arises when the officer has reason to believe the vehicle has been or is being used in contravention of the provisions the section names. In the current text these include:

  • Section 3: driving without an effective driving licence.
  • Section 4: the age limits for driving.
  • Section 39: driving a vehicle that is not registered.
  • Permits: using a transport vehicle without the permit required under Section 66(1), or against a permit condition about the route, area or purpose of use.

For a contravention of Section 3 or 4, or driving without a required permit, the proviso to Section 207(1) lets the officer seize the certificate of registration instead of the vehicle and issue an acknowledgement for it. Detention under Section 207 is meant to be temporary, pending verification of documents, compounding or a decision by the court. Read the current text before advising: the power depends on the specific contravention, and a traffic violation outside the listed grounds does not automatically justify detaining the vehicle.

How to get a vehicle released

Section 207(2) allows the owner or person in charge to apply to the transport authority or an officer authorised by the State Government, with the relevant documents, for release. A practical sequence:

  1. Get the seizure record: the seizure memo or acknowledgement, with the date, place, officer and the provision invoked.
  2. Collect documents: registration certificate, insurance, permit (for transport vehicles), the driver's licence, pollution certificate and owner's identity proof.
  3. Check the offence: identify whether the contravention is compoundable under Section 200 and what the applicable fine is under State notifications.
  4. Apply for release: file the application with the documents before the authority named in the seizure record, and keep a copy with the receipt.
  5. Court route: if the vehicle is held as case property in a criminal case rather than under Section 207, release is sought from the criminal court under the BNSS provisions on custody of seized property (formerly Sections 451 and 457 CrPC).

Preparing a release application or challenge

State the date and place of seizure, the provision invoked, the documents produced, and why the vehicle should be released. If the seizure ground is unclear or does not match the listed contraventions, say so with reference to the seizure memo rather than in general terms. Courts have said the power must be exercised with care and only when its preconditions are met.
